1. About these Terms
These Terms & Conditions apply to the use of the WeeScotland website and to the purchase of products from the store. By placing an order, the customer confirms that they have read and agree to these Terms & Conditions.
These Terms should be read together with the store's Privacy Policy, Cookie Policy, and Returns Policy where applicable.
2. About the seller
The website is operated by Dominik Smrek, sole trader, trading as WeeScotland.

If the business owner does not want to publish a home address, a separate business correspondence address should be obtained before publication, because UK website and ecommerce guidance commonly expects a geographical business address to be provided for online traders.[cite:22][cite:23][cite:30]
3. Products
WeeScotland sells physical goods including wall art, books, stationery, gifts, and other Scotland-inspired products. Product descriptions, images, dimensions, finishes, and prices are shown on the relevant product pages.
Every effort is made to display colours and product details accurately. However, colours may vary slightly depending on the customer's screen settings, lighting, and printing or production tolerances.
Where products are handmade, printed to order, small-batch, or otherwise subject to minor variation, reasonable differences between the website images and the delivered item will not automatically amount to a defect.
4. Orders and contract formation
All orders are subject to availability and acceptance. After an order is placed, the customer will normally receive an acknowledgement email confirming receipt of the order. This acknowledgement does not mean the order has been accepted.
The contract between WeeScotland and the customer is formed only when the store sends a dispatch confirmation email or otherwise confirms that the order has been accepted and processed for shipment.
WeeScotland reserves the right to decline or cancel an order before dispatch where there is a pricing error, stock issue, suspected fraud, breach of these Terms, or another genuine business reason. If payment has already been taken for a cancelled order, the customer will be refunded.
5. Prices and payment
All prices shown on the website are in pounds sterling unless stated otherwise. Prices may change at any time, but changes will not affect orders already accepted.
The total price payable will be shown at checkout and may include delivery charges, taxes, or other fees as indicated before the customer places the order.
Customers are responsible for providing complete and accurate billing and payment details. If a payment is declined or reversed, the order may be delayed, suspended, or cancelled.
If a pricing error is identified after an order is placed but before acceptance, WeeScotland is not obliged to supply the product at the incorrect price. The customer will be contacted with the option to reconfirm the order at the correct price or cancel for a full refund.
6. Delivery
WeeScotland offers shipping to the destinations shown at checkout. Delivery times are estimates only and are not guaranteed unless expressly agreed otherwise.
Orders may be sent using third-party postal or courier services. WeeScotland is not responsible for delays caused by events outside its reasonable control, including postal disruption, customs delays, weather events, or carrier backlogs.
Risk in the goods passes to the customer on delivery to the address provided in the order. Ownership of the goods passes only when full payment has been received.
For international orders, the customer is responsible for any customs duties, import taxes, local handling charges, or similar fees imposed by the destination country unless the store clearly states otherwise.
It is the customer's responsibility to provide an accurate delivery address. Additional delivery charges caused by an incorrect address, failed delivery attempt, or parcel redirection may be charged to the customer where lawful.
7. Right to cancel and change of mind returns
For most online purchases by UK and EU consumers, the customer has the right to cancel the order within 14 days after receiving the goods, without giving a reason, subject to any legal exceptions.[cite:8][cite:11]
Items made to order, or personalized items, cannot be returned, unless arrived damaged.
To exercise the right to cancel, the customer must contact WeeScotland with a clear statement of cancellation before the 14-day cancellation period expires.
After cancelling, the customer must send the goods back within 14 days of telling WeeScotland that they wish to cancel, unless WeeScotland agrees another arrangement.[cite:8]
Returned goods should be unused, in their original condition, and packaged appropriately. The customer may be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.[cite:8]
Unless the return is due to a fault, damage, or error by WeeScotland, the customer is responsible for return postage costs.
Refunds will be made to the original payment method within 14 days after WeeScotland receives the returned goods or receives evidence that they have been sent back, whichever is earlier, subject to applicable law.[cite:8]
8. Exceptions to cancellation rights
The right to cancel may not apply to products made to the customer's specifications or clearly personalised items. It may also not apply where sealed goods are opened after delivery and are not suitable for return for health protection or hygiene reasons, if such products are ever sold by the store.[cite:8]
If WeeScotland sells made-to-order prints, personalised items, or bespoke framed products in future, the relevant product page should clearly state where the cancellation right does not apply.
9. Faulty, damaged, or incorrect goods
Nothing in these Terms limits the customer's statutory rights. If goods arrive faulty, damaged, or not as described, the customer should contact WeeScotland as soon as reasonably possible with the order number and supporting details such as photographs where helpful.
Where goods are faulty, misdescribed, or not of satisfactory quality, the customer may be entitled to a repair, replacement, price reduction, or refund in line with applicable consumer law.[cite:11][cite:16]
10. Intellectual property
All content on the WeeScotland website, including artwork, photographs, graphics, logos, branding, text, layout, and design elements, is owned by or licensed to WeeScotland unless stated otherwise.
Customers may not copy, reproduce, distribute, adapt, publish, sell, or commercially exploit any part of the website or its content without prior written permission, except where clearly permitted by law.
Purchasing a product does not transfer copyright or any other intellectual property rights in the underlying artwork or photography unless expressly agreed in writing.
11. Website use
Customers must not misuse the website, interfere with its operation, introduce malicious code, attempt unauthorised access, scrape the site unlawfully, or use the site for fraudulent purposes.
WeeScotland may suspend access, cancel orders, or take other reasonable action where misuse, suspected fraud, or abuse of the website is identified.
12. Promotions and discount codes
Any promotion, discount code, or introductory offer may be withdrawn, amended, or expire at any time unless specific campaign terms say otherwise.
Unless expressly stated, discount codes cannot be combined, exchanged for cash, or applied retrospectively to completed orders.
13. Reviews, submissions, and social content
If customers submit reviews, comments, photographs, or tagged social content to WeeScotland, they confirm that their content is lawful, accurate, and does not infringe anyone else's rights.
By submitting such content, the customer grants WeeScotland a non-exclusive, royalty-free licence to use, reproduce, display, and share that content for marketing, website, and promotional purposes, unless otherwise agreed.
14. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.[cite:4]
Subject to the above, WeeScotland will not be liable for losses that were not a foreseeable consequence of breach, or for business losses suffered by customers buying as consumers, including loss of profit, loss of business, business interruption, or loss of business opportunity.[cite:4]
15. Events outside reasonable control
WeeScotland will not be responsible for delay or failure to perform obligations where caused by events outside reasonable control, including severe weather, fire, flood, industrial disputes, transport disruption, cyber incidents, supply shortages, or carrier delays.
Where such an event continues for an extended period, WeeScotland may cancel affected orders and refund sums paid for undelivered goods.
16. Privacy and data protection
Personal data will be handled in line with the store's Privacy Policy. Customers should read that policy to understand how their information is collected, used, stored, and shared.
17. Changes to these Terms
WeeScotland may update these Terms from time to time to reflect changes in the business, legal requirements, or website functionality. The version published on the website at the time of the order will apply to that order.
18. Governing law
These Terms are governed by the law of Scotland if the business is operated from Scotland, unless mandatory consumer law in the customer's country of residence applies.
Any dispute will be subject to the jurisdiction of the Scottish courts, except that consumers may have rights to bring proceedings in their own part of the UK or residence jurisdiction where required by law.
